Apex court hearing on PC’s role in 2G scam on Feb 2

A local court hearing follows on Feb 4
February 2 and 4 may well turn out to be most crucial days in the political life of Union home minister P Chidambaram besides leaving a larger impact on the future of the UPA government at the Centre.

The Supreme Court and a Delhi local court are most likely to pronounce their judgements on the involvement of the Congress leader in the controversial 2G spectrum allocation issue.

Thursday next, the apex court may deliver its order on the petition of former minister Subramanian Swamy for a CBI probe into Chidambaram’s alleged role in the scam. Two days later, the Delhi court will make known its judgement on Swamy’s demand to summon the minister for his alleged “collusion and conspiracy” with former Telecom Minister A Raja, now spending his days in jail,  in the multi-crore scam. Both the judgements are reserved.

If at all the courts take serious view of the involvement of the minister, Chidambaram will have no other option but to tender his resignation. This may have serious repercussion on the very future of the Manmohan Singh government and may impact on the Assembly elections in the five states. These judgements are likely to cause ripples in the political and telecom arenas.

Justice A K Ganguly, who has heard the case in the bench accompanied by Justice G S Singhvi, will retire on February 2 and is expected to leave his imprint on the long-expected judgement before the court rises on that day.

Accompanied by Justice Singhvi, Justice Ganguly, known for his forthright views on curbing corruption, had reserved on October 10, 2011, three crucial matters in the 2G case for final orders: the alleged role of Home Minister P Chidambaram in the scam; cancellation of 122 2G spectrum licences allotted by Raja to private companies; and whether a Special Investigation Team is required to monitor the 2G investigation.

In case the judgement is not pronounced, then the matters will have to be heard afresh. “This may be unlikely,” former judge of Karnataka High Court Vishwanath Shetty told Deccan Herald on Friday, “ it is a competent bench and I expect it to deliver the judgement. It is rare that a judgement is not passed in a case that is reserved for judgement.”

However, on Friday, Justice Cyriac Joseph retired from Supreme Court but a case he has been hearing, that of disproportionate assets case against Samajwadi Party president Mulayam Singh Yadav, is still on. But then, this case was not reserved. It will now have to he heard again from the beginning by a different judge. Petitioner in this case, Vishwanath Chaturvedi, told his newspaper: “The case will start all over again now. But I am fully confident that justice will be done.”
In the lower court, Special CBI Judge OP Saini will deliver his judgement on February 4.
